I think some of you are focussing on the legal aspect a little too much. It is one aspect, but not the main motivating factor that led to this decision. The fact is that the boards were starting to look like havens for dealers, and not for the intended target: <b>the individual</b>.
Let's not discuss what's legal and what's not, since it really doesn't matter in this case. What we are here for (and always have stood for) is for the individual selling of parts, new and used.
The point is to stop dealers, NOT the individual that once in a while gets a couple of hard drives at an awesome price and then tries to sell them at market value (or trade for another item of the same market value). If you read the first post in this thread you will see what makes you a dealer, that clearly excludes an individual that once in a while gets a great deal on some items.
The board is also not going just die from not allowing dealers, that is taking the importance of the dealers too far. Besides, if that is true than that is a sad testimonial on how far we have let dealers affect the board to begin with right?
A lot of individuals buy a video/sound card, sell their old one on the board to make up for the $$$ they just spent, then within a week decide that they don't really like it as much as they thought, and sell the new one just to get another video/sound card (which often is the same video/sound card as the one they just sold on the board last week...
). This scenario happens a lot, and if you think about it that one situation alone means that 3 transactions with hardware are happening on the board (sell old stuff, sell new stuff, and buy old stuff again).
Now if that individual has continual access to a ton of drives and then sets up a dealer-style thread (indicating that they simply use the forum to sell and make $$$ off the members by reselling a lot of parts for profit), that is a dealer. This is not that limiting unless you make a regular income (and expect an income) from your sales here. Everyone of us get deals sometimes, but we don't make a living from it.
The For Sale forum is and never was meant for that style of dealer threads, it was always intended for individuals selling and trading their personal items.
One thing on bonkers: he is not banned, he had agreed to some terms in his for sale threads and didn't stick to the terms of that deal several times - simple as that, and he knows that too. It was related to the frequent price changing within existing sale threads, sometimes up/sometimes down.

It's a simple concept really. If you are going out and buying stuff for the sole reason of turning around and selling it on the boards (ESPECIALLY when it's in quantity) then you are pretty much a dealer.

VK was also most excellent as Mad Mardigan in Willow, that look as he is battling the two headed moat monster and is about to jump back in the fray again says "Man what a day this is turning out to be" without saying a word. OK Here's a question then. I am in a group buy of some of the equipment from a place I used to work at.
We will end up getting extra parts, PC's, etc. If I decide to sell/trade on the board in this case...am I a dealer?
I am making a large purchase for some of the equipment but with the knowledge that some of the stuff I just won't want, and I had figured that here is a good place to dispose of it.
I figure I would ask it here and get a proper answer than try and get my a$$ burnt for being an idiot.

Gumby I personally feel that another prerequisite of a dealer is that they do these sales on a regular and ongoing basis. If this is a one time thing or a once a year type thing I don't feel it is a dealer type buy. My .02 centavos worth.

When one gets a deal like Gumby at times I think that is ok. It's when one has things always available and one who buys many things to specifically sell on the forums, they are a dealer. Obviously this will need to be re-defined as we go along so no one will try to skirt the policy.
