Hi fellas,

I'm in the middle of a situation here. In mid December 2000 I entered into a deal with a well known reputable trader on this forum. I had paypalled him the money, quite a bit of money, and he said he had sent it on Dec. 19th, 2000. I've informed him that I needed the items before the end of the year if possible. I've inquired with him last week, noting that the package has yet to arrive. I have told him that I would wait another week, that week ending today, and see how goes. Well, its not here :(
I'm on a time budge and have other things that are pending, only to be held back by waiting on this computer part. I can no longer wait and will have to go out and purchase it locally instead today :(

Now I'm not rich or anything, although I wish :) , so I'd like to be reimbursed for it as promptly as possible and free up the money for other uses. This fellow has told me to wait until he's done some further investigation. How long I do not know.

Would it be wrong of me to ask for my paypal money back now?

Several others have as well asked for refunds, but were only told their orders have been reshipped.

To my understanding, through emails with others who are also in the same situation as I am, they are as well waiting on their orders, some of which being very late (up to a month and longer) and one or two members who've said their orders were found to be lost and sender has resent on two occassions. Now this is not because we're Canadians. There are also a many American fellows who've ordered and are waiting for shipments as well.

I've been around here for quite a long time, and believe my reputation is SOLID and would not go out and scam anybody, that would just simply be stupidity on my part.

I simply want an end to this, as well as many others, one way or another. Patience I do have, but money I do not, that's why I have kindly asked for a refund but was told to wait :(

Most of you guys who were here and on Anand's will know who I'm referring to, but please keep this to yourself for the time being.

Please lmk what you guys think, thanks.

It is not wrong to expect something for your money as a matter of fact if the guy is in breach of an oral contract, litigation is a distinct possibility, so whoever you are,(and we know who you are) get it together and take care of these people you have left hanging.

That is not your problem, it is his and yes you are entitled to ask and get a prompt refund since he couldn't stick to the shipping dates. It isn't your fault he can't stick to the shipping and he shouldn't expect ANY of his buyers to wait if they do not wish too.

I would have to agree and say that if he has shipped the product but you have yet to receive it then he is liable and should reimburse you the money since it is his obligation to ensure that the product gets to you and is in good working order. I know of whom you are speaking of and I know that there is a sudden rash of this happening with him based on what others have said is that he just got overwhelmed. This is not an excuse however nor is it your responsibility. I'd say that he needs to refund your money and if you do wind up getting the product that was agreed upon later due to a shipping holdup then you either send it back or send him the money back. A trader with his reputation should be able to see that to do so is in his own best interests and will go a long ways towards restoring his reputation. I have noticed contrary to what has been posted on Anandtech that he is still selling on other boards. Good luck in getting this issue resolved and sorry for the long-winded response I just wanted to make sure that my 100th post here was a worthwhile one. :)

Thankyou all for your inputs.

Bighammer, if anyone here know's how long it takes for cross-border trades, I'm sure I have a good idea of the timeframe as well as any other Canadian or American. I have done 50+ cross-border deals and have a pretty good grip on what's considered to be reasonable.

Besides, this is not only a Canadian issue as I've stated, there's quite a few of you American folks who are waiting as well.

dood man ups 2 day air mail took till today to get here from canada ontario which was mailed after christmas :(

Listen Pluck, I am contacting Customs in Canada...if the package did NOT reach the border. YOU WILL GET A REFUND!

I DID STICK TO THE SHIPPING DATE AND I WILL INVESTIGATE THIS BEFORE I ISSUE A REFUND. IF IT REACHED CANADA IT"S OUTTA MY HANDS NO MATTER WHAT!!

I am involved in a trade with a Canadian at the moment as well. He shipped express which I verified via the CPS. I still have not received the shipment well in excess of $300. He shipped on 2 Jan 01, should I start to worry? He is also a very respected trader from the great white north!

I wouldn't worry yet Dave, but to state that "IF IT REACHED CANADA IT"S OUTTA MY HANDS NO MATTER WHAT!!" is immature and irresponsible, as a respected trader you should know that it is your responsibility to get the buyer his product to his hands, you would surely speak up if the roles were reversed. If you cannot handle your end of the bargain maybe you should not be trading until you are capable.

I had a 300 watt PS shipped to me from Cali on Dec7, arrived easrly this week.
I honestly think it could still be held up.
If it doesn't make it to you pluck, I hope you 2 guys can solve this without getting into a big fight.

I just did a deal with blackhawk in ontario i'm in massachusetts
it only took 4 days for each of us to get our goodies
is this the norm? or did he and I get lucky?

Plucky the last time you ordered from me How long did it take to reach you after it was shipped? Way too long!
I understand your frustration but I sent the package via Global Priority and was told it would be there in about 4 days with no problems.
I want to check with customs on Monday(if possible) and find out if it reached the border. If the package reached
CANADA then you will need to file a claim with them.If the package did not reach the border then I will refund you immediately.
