For it to be a hate crime, the incident would need to take place against a protected class (race, religion, etc.). This doesn't seem to be the case. The franchise owner could file a civil suit against the former officer if they can prove they suffered loss as a result of the joke and/or recoup loss due to time spent investigating the incident.

This is the best outcome since being an a$$ isn't against the law. Ironically, this guy will probably end up working in the service industry as a result of his actions.
