this is the worst thing I have ever heard. I have heard of people mailing letters into magazines and newsletters complaining about a company and they never had issues. This guy shouldn't be able to do this.....it should be appealed. Next thing you know, you'll have big companies doing the same thing so no one else complains about them. Sheesh........what morons.

<I>"Hello? Are you a lawyer? I want to sue."

"Sue who?"

"Sue ANYONE. Heck, I'll sue YOU."

"Sue me? Why do you want to sue me? I don't even know you. You called ME."

"Sue anyone, right? I can do that. I want litigation."

You are just setting down on a bench beside the peacefull water of your local lake. You look out on the water and there in a small boat you see Mr Novack and his lawyer in a small boat, the small boat is leaking badly and is about to go under. They are both waving frantically at you screaming that neither one of them can swim. The thing is, you only have time to save one of them, one of the two is going to die, so do you........

a.. Read your paper?

b. Eat your breakfast?

(The names in this post do not represent real people, if you can call a lawyer a person, they are all fictitious and exist only in my mind, there is a lot of room there for them, no harm was actually done to either a Mr Novack or any lawyers, lawyers mess themselves up I assure you. By reading this post you agree to waive all rights to sue the poster for those things in this post, those things in the posters mind and any and all previous posts and thoughts by the poster. You waive all rights to sue the poster for anything he's ever done by reading this post, you also waive your right to eat snails. Void where prohibited by law, winner must submit to a background check, not valid without coupon and in any state that allows donkeys in bathtubs. This post is 100% USDA checked and will not cause harmful side effects, in the event that it does you waive all right to damages except in Arkansas where you will have to pay the poster should you be damaged by this post. You may experience some weight gain by reading this post but you waive all rights so shut up about it. This post should be reread every 3000 miles or 3 months, which ever comes first. This post is not responsible for any damages done to small dogs in Chili and can not be taken seriously in any form or fashion, you agree to these conditions by reading this post.)

Seriously though, maybe these guys went a little to far, hacking into the guys computer system etc? Maybe they did attack him rather than just bitch about him and his service. If they were 100% in thier rights then the ACLU or another organization should have been all over this. I don't see them in it???

I've always wondered if and when things like that ("total legal insanity") would begin over words typed in forums but where does it ever stop? I couldn't even begin to count the times I've read posts where people type "don't buy anything from........" as it's very common everywhere online and it's often just a guy mad over things like that guy, late shipping and/or higher shipping costs than expected although one should always know that before ordering and see it in the confirmation.
Whenever I order things (online or whatever) there's always times when things arrive later than expected, sometimes things are BOd, or "the truck broke down" :) (my favorite excuse in my business) but one learns to take it in stride as I'm usually in no rush or I would have just bought it locally.

You know something I thought of.........
many of these companies that would be willing to sue someone has a "budget" for "customer service issues". This company could have reimbursed the customer for the overcharged shipping and the guy would have noted that and there wouldn't have been an issue. Many many customers that post about an issue normally also send in an e-mail to the company that says that they didn't like the service or that they feel they were overcharged.......many times before even posting a complaint to a board. It's only after nothing is done from the company will they post a bad remark about a certian company. I have done that exact thing before, I had an issue with a company, sent them an e-mail first with my complaint, if they didn't do anything within several days (a long time in "internet time"), I post a complaint about 'em. If they do something to fix it AFTER I make the post, I note that or change my original statement. Its called "customer service"......they should try it sometime. It's better to get positive comments about a company then find out the company sued someone. I personally wouldn't ever buy from a company I know they sued one of their customers.

There's one (non-PC type) auto forum I frequent and answer alot of technical questions but being it a forum relating to the same type cars I work on for a living, I'm somewhat known in the manufacturers little community who I know also watches that site so I'm very carefull to always reply there using fake names, no cookies, no e-mail shown and that way only the sites administrator probably knows who it is (if he wanted to track me down) but I can then say whatever I want to (within reason) without having to worry about any legal consequences. I've heard of guys being sued for auto advice that didn't go right, the person didn't understand or failed to do the job right, then sued the guy who told him to do it that way online.

Chilling but not unexpected in today's ligation happy society. Corporations already use lawsuits to shut critics up {SLAPP anyone?}.
